If you're talking about originality, I don't think a layout is something to beat someone up about - especially with the limitations of the web. A few great designers break the mould every decade or so,and inspire a movement. Using a desktop backdrop isn't original, but it is a bit different and it works, and it's a lot better than silasklein site.

Analeis, I don't see any difference whatsoever except for that both designs incorporate desktop elements and, I dunno, the color brown? That's where the similarities end.
It's like saying the Washington Post ripped off the New York Times for using columns in its newspaper.
